SUPPORTER MESSAGING TERMS OF SERVICE

Salsa Labs, Inc. (“Salsa Labs,” “we,” “us,” “our”) provides fundraising, advocacy, and marketing engagement software to nonprofit organizations all over the world. Our software allows our organizational customers (“Customers”) to engage with their supporters through text messages. 

This page contains the terms and conditions (the “Terms and Conditions”) for our text messaging services. By using our services you are agreeing to the following terms and conditions.

  1. The SMS service is operated by Salsa Labs on behalf of our Customers. If our Customers choose to use the SMS service to engage their supporters and you opt-in to receiving their text messages, you will receive messages periodically and message frequency may vary. Messages and data charges may apply. Please contact your wireless carrier for pricing details if you have any questions regarding your plan’s specific rates.
  2. You can cancel the SMS service at any time. Just text “STOP” to 72572. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  3. If at any time you forget what keywords are supported, just text “HELP” to 72572. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
  4. We are able to deliver messages to the following mobile phone carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central, IL (ECIT), Cellular One of Northeast Pennsylvania, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless). 

    Carriers are not liable for delayed or undelivered messages.

Modifications

We reserve the right to change the Terms and Conditions at any time and for any reason without notice to you. Any changes to the Terms and Conditions will be posted on our website, so please be sure to check back periodically. Continued use of this service following a change to the Terms and Conditions constitutes agreement to the modified version.

Termination

Salsa Labs may terminate this agreement at any time in our sole discretion. Salsa Labs reserves the right to change or discontinue any aspect or feature of the service at any time. You agree that we shall not be liable to you or any third-party for any termination or disabling of this service.

Disclaimer and Warranties

Salsa Labs is not liable for any delays related to the transmission of any text messages. Delivery is subject to and dependent upon the applicable network operator. All services are provided “as is” with no warranties by Salsa Labs or its agents, licensors, business partners, and Customers (collectively the “Salsa Labs Parties”). SALSA LABS PARTIES EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.

Indemnification

You agree to indemnify, defend, and hold Salsa Labs and its respective officers, directors, employees, agents, representatives, and affiliates (collectively “Affiliates”) harmless from any claim, action, or demand, and associated costs and expenses (including reasonable attorneys’ fees) arising out of your use of the service or receipt of any text messages.

Limitation of Liability

SALSA LABS’ TOTAL LIABILITY TO YOU FOR ACTUAL DAMAGES FOR ANY CAUSE WHATSOEVER WILL BE LIMITED TO THE GREATER OF $100 OR THE AMOUNT PAID BY YOU FOR THE SERVICE AND/OR CONTENT THAT CAUSED SUCH DAMAGE. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE. THE FOREGOING LIMITATIONS ON LIABILITY ARE INTENDED TO APPLY TO ALL ASPECTS OF THESE TERMS. UNDER NO CIRCUMSTANCES SHALL SALSA LABS OR SALSA LABS PARTIES, AS APPLICABLE, BE LIABLE FOR ANY UNAUTHORIZED USE OF THE SERVICE.

Miscellaneous

These Terms and Conditions will be governed by and construed in accordance with the laws of Maryland, without giving effect to the conflict of laws or provisions of Maryland or your actual state or country of residence. Any dispute arising from these Terms and Conditions shall be adjudicated in Montgomery County, Maryland. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, the remainder of these Terms and Conditions will continue in full force and effect. These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by Salsa Labs.
